Welcome to BRCA Bros ("BRCA Bros," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the BRCA Bros website and, once available, its community features (together, the "Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. Eligibility
You must be at least 18 years old to use BRCA Bros. By using the Service, you confirm that you are 18 or older. We may ask you to verify your age or suspend accounts we reasonably believe belong to someone under 18.
2. What BRCA Bros Is (and Isn't)
BRCA Bros is a community and information resource for men with BRCA1 or BRCA2 mutations and their families. BRCA Bros is not a medical provider, does not diagnose or treat any condition, and does not provide medical advice. Nothing on this site, including the Learn and Prevention pages, member posts, or replies, is a substitute for advice from a qualified doctor or genetic counselor. Always talk to a healthcare professional about your own situation before making medical decisions.
3. Accounts and Member Conduct
When account creation becomes available, you're responsible for keeping your login credentials secure and for activity that happens under your account. You agree to use the Service in line with our Community Guidelines, which are part of these Terms. We may suspend or terminate accounts that violate these Terms or the Community Guidelines, including for harassment, harmful medical misinformation, or repeated abuse of the reporting system.
4. Your Content
You keep ownership of anything you post, including profile information, posts, replies, and photos ("Your Content"). By posting, you give BRCA Bros a non-exclusive, worldwide, royalty-free license to host, store, and display Your Content solely to operate and improve the Service. You're responsible for Your Content and confirm you have the right to post it. We can remove Your Content that violates these Terms or the Community Guidelines.
5. Privacy and Sensitive Information
Your use of the Service is also governed by our Privacy Policy. BRCA status and other health-related information you choose to share is sensitive. We only show it to other members if you explicitly turn that on in your profile settings; it's hidden by default.
6. Termination
You can delete your account at any time. We may suspend or terminate your access if you violate these Terms, the Community Guidelines, or applicable law, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination, such as limitations of liability, will continue to apply.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BRCA BROS AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED $100.
9. Governing Law
These Terms are governed by the laws of the United States and the state in which BRCA Bros' operator resides, without regard to conflict of law principles.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here with a new "Last updated" date. Continued use of the Service after changes take effect means you accept the updated Terms.
